guidelines) Administered by the Empire State Development Corporation (ESDC)in coordination with the
New York City Economic Development Corporation on behalf of the State of New
York. This program is funded by HUD.
The application deadline is December 31, 2002 and may be extended. Applications are available at 2 Rector
Street and 140 William Street. Both are handing out, reviewing and accepting

The business’ federal income tax return for the most recent
fiscal year ending before 9/11/01. ·
The business’ lease, deed, or permit for the business
premises in the Eligible Area as of 9/11. ·
The business’ current lease if it has relocated to a new
location within NYC. ·
A completed Form 8821 authorizing ESDC to access tax returns
from the IRS. ·
If the premises were leased, copies of both sides of
cancelled rent checks for July, Aug., Sept. 2001 and a copy of a utility
bill for either July, Aug., or Sept. 2001. ·
A voided check for the business’ bank account, imprinted
with the legal name and address of the business. (It is ESDC’s intention to
electronically transfer grant awards directly into business accounts.) Frequently
asked questions: What types of businesses qualify for
the grant? An
Eligible Business is a for-profit business entity or not-for-profit
organization with fewer than 500 employees worldwide that was located as of
Sept. 11, 2001 on or south of 14th Street and has maintained or will
resume a business in New York City. Street Vendors are considered eligible
businesses. My business has several locations
within the Eligible Area. Can I apply for a grant for each location? Yes.
A business having several locations within the Eligible Area may apply for a
grant for each Location. In no case will the total grant assistance provided to
any business from HUD funded WTC
programs exceed $500,000. Can I apply for this grant if I’ve already received grant
monies from the previous retail grant? Yes.
Businesses that received a grant from the earlier WTC Disaster Retail Recovery
Grant Program may apply for additional Assistance through the WTC Business
Recovery Grant Program. How is the grant calculated for
disbursement? Depending on location within the Eligible Area, eligible
for-profit businesses may receive grants based on average daily gross sales or
revenues lost (based on a 250 day business year). Grants to Eligible
not-for-profit organizations will be based on average daily total revenues
(line 12 from a 990 return). Grants are calculated in the following manner: How do I receive additional compensation if I have already
applied and received money? Previous recipients will receive
affidavits by mail to reaffirm that their original application info is
accurate. After signing & returning that form, ESDC will wire the
additional funds to them. ***Please note new compensation guidelines: Area Days

Small Firm Attraction and Retention Grants Administered by the Empire State
Development Corporation (ESDC) in coordination with the New York City Economic
Development Corporation (EDC) on behalf of the State of New York. This program is funded by an appropriation
from the US Department of Housing and Urban Development. It is the objective of this program to
help retain and create jobs in New York City by assisting businesses employing
up to 200 individuals within the eligible areas. Note: this program has been
approved for firms under size 10. ESDC/ EDC will provide two payments of
$2,500 or $1,750 per employee based on the company’s location and a completed
application as follows: Eligible Companies: Small Firms
that commit to located South of Canal Street for at least 5 years. Small Firms
that were located in or near the WTC who commit to stay downtown for at least 5
years. Small Firms
that were located in or near the WTC who commit to stay in NYC for at least 5
years. Eligibility
Criteria: The Company must have a current lease
expiring no later than 12/31/04, have been located in the Restricted Zone that
was in operation until 10/23/01, be commencing operations in Lower Manhattan,
or be relocating into Lower Manhattan. The company must sign a new lease or
renew an existing lease for a minimum of five years beyond the current commitment.
The new lease must be signed not earlier than 9/11/01 and not later than
12/31/04. Following signing or renewal of the
lease, the company must employ no more than 200 employees in an establishment
in the eligible area. The new lease is for space located in
the area on the south side of the line beginning at the intersection of the
Hudson River with the Holland Tunnel, and running east to Canal Street, then
running along the centerline of Canal Street to the intersection with Rutgers
Street and running along the centerline of Rutgers Street to the East River. Applications are available at the

Retention Program

Cash grant determined on a case-by-case basis and decisions
will be based on the economic value of the business or project to New York
City, risk, location and size of workforce. ·
Business employs more than 200 employees South of Canal
Street. ·
Businesses must retain jobs in New York City for a minimum
of seven years. Businesses must commit
to retaining jobs after September 11, 2001 and no later than December 31, 2004.
Additional assistance will be offered to businesses that relocate to lower
Manhattan and contribute to the rebuilding of the business community there. ·
No application deadline, however, a limited amount of funds
are available for this program. ·

·
The New York State Energy Research and Development Authority
(NYSERDA) is offering low-interest loans for residents and businesses with
properties in the Liberty Zone. ·
Borrowers located in Lower Manhattan, specifically the
southern tip of Manhattan to Canal Street, can receive an interest rate
reduction of up to 6.5 percent off the lender's interest rate. The loans,
normally reduced by an interest rate of up to 4.5 percent, can be used for over
50 pre-qualified energy upgrades and other improvements associated with
building renovations. ·
The maximum loan amount has been increased to $1,000,000 for
eligible pre-qualified and custom improvements for non-residential properties.
Up to $500,000 can be added for green building projects, including measures
that are environmentally sound or use renewable energy sources. The maximum
loan amount for multifamily properties (those with five or more units) remains
at $5,000,000 or $5,000 per unit, whichever is less. ·
Eligible borrowers may be commercial, industrial,
not-for-profit, institutional, residential, or multifamily and must be
responsible for payment of the building's utility bills. Only Con Edison
customers in the Liberty Zone are eligible to receive the special loan rates
that are being announced today. ·
Lenders participating in the Loan Fund program in the New
York Metropolitan area include Amalgamated Bank of New York, Banco Popular,
Bethex Federal Credit Union, Charter One Bank, Community Capital Bank,
Community Preservation Corp., Flushing Savings Bank, HSBC, Independence
Community Bank, The Low-Income Housing Fund, Lower East-Side People's FCU,
M&T Bank, New York Business Development Corp., Signature Bank, State
Employees Federal Credit Union, and Union State Bank. ·

Up to$375 is available toward the price of a new Energy
Star® room air conditioner or eligible
through-the-wall model. ·
This program is for companies with 10 employees or less who
are located at or below Canal Street. ·
A customer who has received a directly mailed application
from Con Edison will drop off an old air conditioner unit and buy a new,
qualified room air conditioner unit from a participating retailer at or below
14th Street, Manhattan. (If you have already received a $75 Keep Cool Bounty,
you may apply for the difference.) ·
This program runs until October 31, 2002. Limit of one
incentive per business. ·

To assist in the rebuilding and revitalization of Lower
Manhattan, the U. S. Department of Housing and Urban Development is providing
the Lower Manhattan Development Corporation with a $2 billion Community
Development Block Grant. Funds totaling $700 million have already been
allocated to the state to assist not-for-profits and businesses in Lower
Manhattan. The Lower Manhattan Development Corporation (LMDC), a
subsidiary of Empire State Development, has developed a Draft Assistance Plan
for Individuals. The Plan offers financial assistance to eligible individuals
who currently live and agree to remain in specified areas of Lower Manhattan
while creating financial incentives to encourage individuals to move to the
area. The Plan also provides job training assistance to affected individuals to
help prepare them for employment at companies in Lower Manhattan. The Plan has

City Investment Fund’s Financial Recovery Fund
Recoverable grants ranging from $25,000
to $250,000 are available to businesses that had been operating south of Canal
Street (changed from Chambers) for at least six months prior to September 11th,
and have between 4 and 100 full-time employees (except retailers, restaurants,
and manufacturers, which must have 50-100). In addition to providing interim
financing to a company while its business returns to sustainable levels, the
Fund also will provide strategic assistance, such as business mentors, to its
grantees. The intent of a recoverable grant is to
provide interim financing to a company while its business returns to
sustainable levels. If a company is then able repay the grant, this would
enable us to provide similar financing to other businesses. Terms of the recoverable grants are: 0%
interest rate, no collateral requirements, funds may not be used to repay debt
existing prior to 9/11, and businesses that meet the following eligibility
requirements can apply for a recoverable grant: Legally incorporated in the
U.S., Located south of Canal Street before 9/11, In business for at least six
months prior to 9/11, Between 4 and 100 employees (except retailers, restaurants,
and manufacturers, which must have 50-100), Current on taxes, Viable before and

Retention Project
An additional $1.53 million has been
received from five corporate sponsors: the American Express Foundation, Bank
One Foundation, the McCormick Tribune Foundation, Warburg Pincus, and the
William Randolph Hearst Foundation. About 300 small businesses inquired
about the funds after Seedco stopped accepting new applications. Those
businesses‘ applications will be reviewed in the order in which they inquired
about the financing. For small retail or manufacturing businesses on or below
Canal Street. Administered by the Alliance for
Downtown New York, Seedco, and Asian Americans for Equality / Henry Street
Settlement (AAFE). The Alliance and AAFE will identify
needy businesses in their communities, direct appropriate resources to them,
and advocate on their behalf. Seedco will oversee distribution of the loan and
grant funds, manage the wage subsidy component, and provide technical
assistance. Three kinds of services are available: Financial Assistance: Low-interest
loans of up to $100,000 with terms between six months and three years are being
offered. Loans can be used for working capital or to bridge the gap before
receipt of funding from other sources. Grants of up to $25,000 will be

Manhattan Small Grocer Initiative
The Lower Manhattan Small
Grocer Initiative to help delis, bodegas, newsstands,candy stands, quick
service restaurants, corner stores, hot dog stands, pizza parlors and other
convenience stores below Houston Street has been launched by Seedco. Eligibility criteria
includes: Ø
Businesses must be located in Manhattan on or below
Houston St; and, intend to stay there. Ø Businesses
must employ less than 50 Ø Businesses
must demonstrate adverse impact from 9/11 attack Ø Businesses
that are at risk for layoffs Ø Businesses
must be able to demonstrate financial viability prior to 9/11. The program was launched
with $3 million, including a $1.5 million grant from the PepsiCo Foundation and
smaller donations from other groups. The program will offer loans and grants
along with wage subsidies to businesses.

organizations
Mellon Foundation Grant: Grants of
$250,000 to $2 million for NYC cultural and performing arts organizations: A
$50 million fund targeted at cultural and performing arts organizations
directly affected by the events of 9/11. Candidates will need to submit a
proposal that documents the direct financial and other consequences they have
experienced as a result of 9/11. Individuals are not eligible. Organizations

announced a round of city grants for small and midsize arts organizations and
artists, for losses incurred after Sept. 11. The funds will come from the $2.5
million grant that the city made to Broadway in December. A good portion of the
grant has been returned to the city because Broadway rebounded more quickly
than expected. The Lower Manhattan Emergency Preservation Fund
The Lower Manhattan Emergency
Preservation Fund was formed after 9/11 to make grants to help alleviate the
impact of the disaster and to stabilize, renovate, and restore damaged historic
sites in Lower Manhattan. It is a consortium of five prominent historic
preservation organizations, the World Monuments Fund, the National Trust for
Historic Preservation, Preservation League of New York State, Municipal Art
Society, New York Landmarks Conservancy.
Historic sites eligible for grants from the LMEPF include secular and
religious structures, open spaces, and works of art. In awarding grants,
preference will be given to nonprofit applicants and to uninsured or
under-insured owners. Requests may be made for planning, documentation,
evaluation, construction, and advocacy activities. Please visit our web site

is New York State program designed to help companies to keep from laying off
staff. This
is accomplished by allowing an employer to reduce staff hours or wages from
20%-60% per week and subsidizing wages through unemployment insurance benefits.

SBA representatives are distributing
applications at 140 William Street. The SBA (1-800-659-2955) has relevant
information on its website at http://www.sba.gov/disaster/newyorkfires.html Three disaster
loan programs are available through the SBA. The maximum disaster loan amount
made to business concerns and non-profits located in the declared disaster
areas of New York is $10,000,000. The maximum loan limit is applied to the
combination of both physical and economic injury disaster loans. The deadline
for these programs has been extended to January 31, 2003. Loans to
businesses to repair or replace disaster damages to property owned by the
business, including real estate, machinery and equipment,
inventory and supplies. Businesses of any
size may be eligible. Nonprofit organizations such as charities, churches,
private universities may also be eligible. ·
Economic Injury Disaster
Loans (EIDL) for Small
Businesses Loans for working capital to small
businesses to assist them through the disaster recovery period. Loans cover
operating expenses the business could have afforded to pay, if the disaster had
not occurred. Also covers having lost an "essential employee" to
active duty as their role as military reservist. Eligible businesses now include: private,
non-profits (PNPs) located in the declared disaster areas of New York. The
PNPs must be within the small business size standard. Small finance and

Travel agencies (eligible for up to $3 million) For EIDL only, payments of
principal and interest shall be deferred and no interest shall accrue during
the two-year period following the approval of this loan. This applies to small
business concerns and private non-profits located in the declared areas of New
York as a result of the 9/11 terrorist attacks. Higher payments may be
calculated as a result of the deferment. For currently approved EIDL's,
recalculations will be completed via computer. ·
Disaster Assistance Loans
for Homes & Personal Property Loans to homeowners or renter to repair
or replace disaster damages to real estate or personal property owned by the

Assistance
For businesses,
FEMA also offers disaster unemployment assistance for those out of work as a
result of the disaster, including self-employed persons and others not normally

(MRA) program -
FEMA's new program provides assistance to disaster victims
about to lose their primary residence as a result of financial hardship caused
by the WTC attack. -
Whether potential applicants live in the state of New York
or elsewhere, they may be eligible for MRA if their employment was directly
affected by the damages in the WTC impact zone. -

FEMA has extended its deadline for filing physical damage
claims from 6/11 to 9/30/2002. The New York Liberty Bond Program is an
$8 billion initiative to provide low cost, tax-exempt bond financing for major
projects to revitalize Lower Manhattan. The program is intended to secure
significant private sector investments to rebuild Lower Manhattan. The Liberty Zone is the area located on
or south of Canal Street, East Broadway (east of its intersection with Canal
Street), and Grand Street (east of its intersection with East Broadway). To be
considered for financing, projects must be consistent with one or more of these
goals and satisfy the application guidelines. The Liberty Bond Program seeks to: ·
repair and replace damaged and destroyed commercial space, ·
upgrade existing commercial space, ·
create multi-family residential rental and retail
development, ·
provide modern office space for displaced and decentralizing
businesses in central business districts throughout the City, ·
attract new residents and employers to New York City, and
encourage environmentally responsible design and construction. The New York City Industrial
Development Agency (IDA) and the New York Liberty Development Corporation
(NYLDC) will issue bonds for commercial projects. The New York State Housing
Finance Agency (HFA) and the New York City Housing Development Corporation
(HDC) will be the issuers for residential projects. Projects seeking Liberty Bond financing
must also meet certain minimum square footage and expenditure requirements. The
commercial guidelines require that construction projects located within the
Zone must create at least 20,000 square feet of commercial space. Construction
projects outside the zone, but within the City, must create at least 100,000
square feet of contiguous commercial space. Renovation projects within the Zone
must renovate at least 50,000 square feet of contiguous commercial space and
involve expenditures for base building improvements of at least $50 per square
foot. Projects outside the Zone, but within the City, must renovate at least
100,000 square feet of contiguous commercial space and involve base building
expenditures of at least $100 per square foot. The guidelines for residential projects
require the projects be located within the Zone. Projects may entail new
construction, conversion of a commercial facility, or substantial renovation of
an existing residential facility. Rehabilitation expenditures must equal at
least 50% of the amount of New York Liberty Bonds. Both HDC and HFA are
requiring an additional public benefit as part of the liberty Bond Program: HDC
will impose additional fees to be used to preserve and create affordable
housing throughout the City, while HFA will require that at least 5% of the
units be affordable to moderate income families. For more information on the New York

is a loan program for micro-business owners not eligible for SBA loans. Program
is committed to working with self-employed individuals who lack access to

Johnson and Johnson, as well as a recent $500,000 grant from JP Morgan. The

St. WTC Economic Recovery Power Program

The Program offers discounted energy to eligible businesses
in Lower Manhattan as part of legislation signed by the Governor reallocating
up to 80 megawatts of low-cost power and energy formerly allocated to the Port
Authority for its tenants at the World Trade Center. Companies receiving
benefits under this Program may save approximately 25% off their bundled ConEd
bills. Benefits last for three years. To qualify, companies must be in one of
three priority categories (see below), and must have a minimum peak demand of
at least 20 kilowatts of power. Eligibility -
The Program is available to any business south of the
centerline of Houston Street in Lower Manhattan that has a minimum peak demand
of at least 20 kilowatts of power (usage typical of companies occupying
approximately 2,900 square feet of office space). -
The 80 megawatts of power in this Program will be allocated
based on the following priority categories. That is, companies in Priority 1
will be given first consideration; companies in Priority 3 will get final
consideration. The power will be allocated until all 80 megawatts are
distributed to the eligible companies. Priority 1 Former tenants of WTC buildings 1, 2,
4, 5, 6 and other companies that were displaced at least 30 days that have
re-established their businesses south of Houston Street. Priority 2 Same as above except that the companies
have re-established their businesses elsewhere in New York City (i.e., outside
of Lower Manhattan). Priority 3 Businesses south of Houston Street (old
or new) that commit to retain or create jobs south of Houston Street. Application Process Applications are available at the
walk-in center at 140 William St and on www.newyorkbiz.com.
Completed applications must be submitted to the New York Power Authority in
White Plains (800-622-NYPA; www.nypa.gov). Businesses that are accepted into the
Program must then sign a three-year contract with the Port Authority. Companies
in the “Priority 3” category must also sign an agreement with NYPA as to the
companies’ job commitments. Applications for companies in Priority
1 and 2 categories are currently being accepted. Applications for Priority 3
companies may be submitted but will not be reviewed until May 3. Because this Program operates on a
first-come first-served basis, and because the amount of available power is
limited, it is highly advisable for companies to apply as soon as possible. There are several
options for companies needing space: -
Beginning February 1st, KickStart downtown will have office
suites to staff 10-15 people or 4-5 people. The midtown location near Penn
Station will accommodate 2-7 people. The rates have dropped from $665 to $500

Administrative Judge of the Civil Court, working with the Legal Aid Society,
the Association of the Bar of the City of New York, Stroock & Stroock &
Lavan and Latham & Watkins, has overseen the creation of the 9/11 Small
Business Court Assistance Project to address commercial lease disputes. The mission of the Project
is to transform eviction proceedings into opportunities to explore mutually
beneficial resolutions, avert business dislocation, and contribute to
resurgence of the downtown areas affected by the WTC tragedy. The Project, which
establishes a Special Calendar to hear these cases, is set to begin at the
Manhattan Civil Court on June 4, 2002. The Special Calendar will
feature intensive mediation services to facilitate settlement, lead by
experienced mediators from Safe Horizons, the Dispute Resolution Program of the
Civil Court, and JAMS. Small businesses that do not already have lawyers will
be provided with pro bono counsel from law firms, the Civil Court and Legal Aid
pro bono panels, and through the cooperation of the City Bar, the New York
County Lawyers Association and the New York State Bar Association. The Project
will recruit practitioners already familiar with Housing Court and commercial
lease litigation and negotiation. All mediation and legal
services will be rendered without charge in an effort to aid in the recovery of

Liberty Zone Business Employee Credit The Job Creation and Worker Assistance
Act of 2002 was signed into law on March 9, 2002. Included in this act is the
Liberty Zone Package that provides additional federal tax incentives specially
formulated for businesses located south of Canal Street. These businesses may
benefit from the following: -
The New York Liberty Zone Business Employee Credit offers a
credit of up to $2,400 per employee for two years. Companies that employ 200 or
fewer employees in the Liberty Zone are eligible for this credit in 2002 and
2003. -
A 5-year recovery period (versus the standard 39-year
recovery period) for depreciation of certain leasehold improvements for
property placed in service after September 10, 2001 and before January 1, 2007.

A first-year "bonus" depreciation deduction equal
to 30 percent on real and personal property located in the Liberty Zone that is
repaired or replaced as a result of the WTC attack. -
An extended replacement period to 5 years (versus the
standard 2 years) to purchase property replacing that was damaged or destroyed
on September 11, 2001. Substantially, all of the replacement property's use
